Woman arrested in fatal Owens Cross Roads dog attack

MADISON CO., Ala. (WAFF) – A woman is in jail following a months-long investigation after a dog killed a 2-year-old in March.

On Thursday, Melissa Phillips turned herself in at the Madison County Jail for violating “Emily’s Law”. Emily’s law pertains to dangerous dogs in the community.

On March 1, 2-year-old Mark Alan Partain was killed while playing with his neighbor’s dogs in his neighbor’s yard. The home was on T.R. Christian Road in New Hope.

During the investigation, two dogs were found at a neighbor’s residence and were seized due to their potential involvement in the attack. Detectives also discovered that a third dog, located down the road, might have been involved in the attack.

The owner of the third dog surrendered their pet to law enforcement while the investigation continued. All three dogs were handed over to Madison County Animal Control.

Investigators discovered that one of the three dogs was in a reported dog attack in January. With the help of a forensic odontologist, they were able to collect bite impressions and rule out the involvement of two of the initial dogs in the child’s death. The dogs involved in this incident have all been euthanized.

Phillips was booked on a $15,000 bond but has since been released.
