Trial date set for former Fillmore County dogs’ owners

PRESTON, Minn. (KTTC) – After a pretrial hearing Tuesday morning, Fillmore County has set a trial date for the court cases of Donald Anderson and Elham Alayyoub, the farm owners who had their German Shepherd dogs seized by authorities.

Both Anderson and Alayyoub entered a not guilty plea. According to Anderson’s attorney Zach Bauer, an expert is needed to be hired for this case. He stated the expert has yet to be identified, and requested a trial date in February.

According to Alayyoub’s attorney Dan McIntosh, her case will proceed with similar information used in Anderson’s. He added additional witnesses may be called to testify about the origins of the German Shepherd dogs.

The trial date for both cases is set for February 10 at 9 a.m. The county also set settlement conferences on January 17 at 1:30 p.m. for Anderson and 2 p.m. for Alayyoub.

15 German shepherds were seized from the Anderson’s property in Fillmore County’s Beaver Township in February.

The Andersons, who breed German shepherds, met with Dan Dornink, a Fillmore County investigator on February 9, stating they believe their dogs had been poisoned by a neighbor. Court documents state two dogs died several weeks apart under similar circumstances.

On February 13, Dornink visited the farm. Upon petting the dogs, he felt the dog’s ribs. Then when he went to go look at the kennels, the documents say the floors were bloody and soiled.

A local vet examined the puppies and determined them to be extremely unhealthy. The vet used a scale of one to nine. Nine is the healthiest. All of the dogs were rated as a two, except two of them which were rated a two-and-a-half.

The dogs were officially taken by the county and turned over to the Animal Humane Society in Golden Valley on February 22. All of the dogs at Golden Valley have been adopted.
