Texas man arrested after 3 dogs kill neighbor, 65, who tried to fend them off with hammer

A Texas man has been arrested after his three dogs fatally mauled a woman. He also faces an unrelated murder charge.

Marshall Garrett, 38, was charged Tuesday with three counts of dog attack resulting in death. The same day as the attack, he had been “warned that they were loose,” according to court records obtained by ABC News. Houston police say that on March 23, Garrett’s three Staffordshire mixes mauled and killed 65-year-old Harriette Phillips, one of his neighbors.

Phillips was walking to one side of her backyard when it “appeared that the defendant’s dogs had broken through her fence,” court records say. Her home security cameras show her “scanning her backyard looking for something” while hitting the fence with a hammer. Garrett’s dogs “returned through the broken fence and attacked her.” Records say Phillips started yelling for help and trying to use the hammer in self-defense.

Court documents say Garrett didn’t see the attack but “realized what occurred afterward and called 911.”

Police say that just hours before the attack, Garrett received a text message from a neighbor that the dogs had been digging and going into Phillips’ yard. Garrett allegedly responded, “Oh lord, I’m about to get it resolved.”

All three dogs were euthanized after the attack.

Man arrested for dog attack is charged with murder in different case

At the time of the fatal dog attack, Marshall Garrett was out of jail on a $250,000 bond for allegedly evading police, ABC News reports.

Garrett is a co-defendant in an October 2024 murder case, along with Latrecia Washington. According to law enforcement, the two got into an argument with Alton Martin, 69, over $140. Garrett and Washington violently assaulted Martin outside a discount store in Houston. Martin died from his injuries.

Houston arrest records say Garrett’s next court appearance for the murder charge is Thursday, April 17.
