
MOBILE, Ala. (WALA) – FOX10 News has an update on an alleged animal cruelty case in Mobile.
A Mobile County judge has ordered 30 out of 34 dogs be returned to their owner.
On May 5, the dogs were removed from a home in Trinity Gardens, after a complaint was filed saying the animals were living in horrible conditions.

According to city officials, the question lies with the Judge on why the dogs were returned to the owner.
The City of Mobile Animal Services was complying with a court order by Municipal Court Judge Shelbonnie Hall.
While several of the animals have been returned, the owner identified as Marquis Nodd, is still facing over 100 criminal charges.
The list of charges brought against Nodd includes the following:
- Sec. 7-6: No rabies vaccines – 34 counts
- Sec. 7-7: No city license or microchip – 5 counts
- Sec. 7-8: Shelter and care – 34 counts
- Sec. 7-9: Animals trained to fight – 26 counts
- Sec. 7-17: Potentially dangerous animal – 2 counts
- Sec. 7-21: Public Nuisance (odor) – 1 count
- Sec. 7-22: Hoarding Animals – 1 count
- Sec. 7-23: Improper Tethering – 10 counts
- Sec. 7-25: Cruelty/Neglect/Abuse – 5 counts
It’s unclear why so many dogs were being kept at the location on Carter Street.
Director of Animal Services Robert Bryant said many were found in various states of neglect.
“On face value, it looked like a very, very large breeding operation, a backyard breeding operation,” Bryant said. “Several of the animals were being kept in what we call whelping pens. It’s kind of a boxed cage that breeders use to raise puppies in. Several of the dogs were tethered around the property.”
Four of the dogs had to be rushed to a vet for immediate treatment.
Those four will not be returned.
They will remain in the custody of animal services and be offered up for adoption.
Nodd is also ordered to meet the following conditions, including:
- Each dog must be properly vaccinated by a licensed veterinarian.
- The owner shall agree to allow the City of Mobile Animal Shelter to inspect and monitor the shelter and care of these dogs for a period of twelve (12) months.
- The owner must pay the cost of care, treatment, and maintenance that has been provided for the animals pursuant to Ala. Code Sec 13-11-245.
FOX10 News did reach out to Nodd to get his comment. He deferred us to his lawyer.
We have not heard back from his attorney.
FOX10 News is also working to get a comment from Judge Hall on her order allowing the dogs to be returned.
