This fan did not have a pissin’ good time at the park.
The Marlins and the City of Miami are being sued by one fan for allegedly slipping on dog urine during the team’s “Bark at the Park” event last year at loanDeport Park.
The barking mad fan — Luann Hahn — is looking for $50,000 and a jury trial, as first reported by Miami-based reporter Andy Slater.
“As plaintiff was walking on the premises that was not designated for dogs to be in she slipped on an (sic) dog urine on the floor causing her to fall onto the ground,” the lawsuit, obtained by The Post, reads. “The existence of the liquid on the floor created an unreasonably dangerous and unsafe condition.”
“Bark at the Park” games have become popular among baseball teams, with fans having their chance to bring man and woman’s best friend to the park while they enjoy America’s Pasttime.
Now, yes, there are certain logistic issues.
Dogs, well, are not trained to use the human restrooms. You can’t exactly let Fido off the leash and tell him to go to the bathroom.
Accidents will happen unless this is the greatest-trained group of pups.
And that’s allegedly what happened here.
The lawsuit cites April 14, 2024 as the date of the alleged incident, but the team’s online schedule does not list that game having a “Bark at the Park” promotion.
That schedule lists said event happening April 1, April 15 and April 29.
Bally Sports highlighted an explosive detections dog named Atlas during the promotional event for the 7-2 loss to the Nationals on April 29.
It is not known if Atlas is the alleged perp, but he does look like a good boy and served two years in the Middle East — and now this writer is evaluating what he’s done with his life.
Anyway, back to the dogs.
“Bark at the Park” nights actually come with a waiver with the provision “you must execute this release and agree to its terms in order to enter loanDepot Park and the surrounding area (The ‘ballpark’).”
It also includes notable details, including waiving the right to sue.
“I further assume any and all risks associated with my participation in the Event, including, but not limited to, illness, traveling to and from the Event, falls, contact with spectators at the Event, injuries or damages including death sustained by and through other participant dogs…,” the waiver reads.
“In consideration for allowing me to participate in the Event with my Dog, I hereby for myself, my heirs, executors, and administrators or anyone acting on my behalf, waive, release, covenant not to sue, and fully defend, indemnify, hold harmless, and discharge Major League Baseball Properties, Inc., MLB Advanced Media, L.P., the Office of the Commissioner of Baseball, Marlins Teamco LLC, each of the other Major League Baseball clubs, Marlins Funding LLC, Marlins Holdings, LLC, Marlins Stadium Operator, LLC, Marlins Stadium Developer, LLC, City of Miami, Miami-Dade County…”
The alleged suspect dog has yet to comment on the lawsuit.
