
MADISON, Wis. (WMTV) – The Jefferson County court case against the owner of Penny Lane Cocker Spaniels is set to be dismissed, according to court documents.
The motion was filed on Thursday by District Attorney Monica Hall after she states the defendant died.
“We learned this information from the person working with her on competency restoration and verified this through the Sheriff’s Office,” wrote DA Hall.
The defendant faced 40 misdemeanor charges, 20 for intentionally improper animal shelter space and 20 for intentionally improper animal shelter- ventilation. Class A misdemeanors have a maximum penalty of nine months in prison and a $10,000 fine, if convicted.
Back in January, the case was put on pause after the former breeder and owner was found not fit to move forward in court.
The majority of the dogs at Penny Lane were removed from the property last year.
