Memorial Park, although owned by Codington County, is situated within the city limits of Watertown, making the City of Watertown’s ordinances regarding animal control applicable to the area. According to City Ordinance, “a dog or cat shall be deemed to be running at-large when off or away from the premises and not under the control of the owner… by means of a leash, except in areas designated as ‘off-leash’ by the City.” Furthermore, the ordinance concerning “Dogs and Cats on… Municipally Controlled Public Parks and Recreation Areas” states that “in all other municipally controlled public parks and recreation areas, dogs or cats shall not be permitted unless controlled by a leash to prevent the dog or cat from biting any person or other animal.” While the ordinance references “municipally controlled” parks, the intent to ensure public safety through leash requirements aligns with the concerns raised at the County level regarding a park within city limits.
