Defendant sentenced to 6 years, accused of encouraging dogs to attack police officer

A defendant accused of encouraging his dogs to attack Columbus Police officers who were serving a parole warrant at the home has been sentenced in Bartholomew Circuit Court.

James Henry, 53, whose address at the time of his arrest was 1516 Sycamore St., Columbus, was arrested on Aug. 13, 2024 on charges of battery against a police officer, battery with a deadly weapon, resisting law enforcement and an out-of-county warrant, according to court records.

Columbus police went to Henry’s home and initially asked his wife to have him come out of the residence, and tried to contact him through the use of an in-car public address system, according to the Bartholomew County prosecutor’s office. When he would not exit the home, officers assembled an entry team and breached the residence to arrest Henry, according to the prosecutor’s office.

As officers searched the house to arrest Henry, they heard Henry shout “get them, get them,” at several dogs inthe residence, leading to Sgt. Brandon Decker being bitten by one of the dogs. Officers then used “less than lethal devices” as well as “necessary force” to subdue and arrest Henry, according to the prosecutor’s office.

Bartholomew Circuit Judge Kelly Benjamin sentenced Henry to six years in prison on April 24 after Henry was convicted of battery resulting in bodily injury to a public safety official, a Level 4 felony.

The sentencing range for a Level 5 felony is 1 to 6 years, with an advisory sentence of three years.
